These Terms of Service (“Terms”) outline your rights and responsibilities when you use our website, products, or services. Please read them carefully. These Terms govern your access to and use of the services and products we offer, collectively the “Services”.

Please read these Terms carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by all of the Terms and all other operating rules, policies, and practices and procedures that we may publish via the Services from time to time, collectively, the “Agreement”. You also agree that we may automatically change, update, or add on to our Services as stated in the Terms, and the Agreement will apply to any changes.

1. You and Santal Wellness

“You” refers to any individual or business accessing or using our services. If you’re acting on behalf of someone else (such as an organisation or company), you confirm that you have the authority to agree to these Terms on their behalf.

2. Accounts and Information

To access certain features, you may need to create an account or provide personal information during checkout. You agree to supply accurate and current details. We may limit access to our services until verification is complete.

By creating an account, you agree to receive communication from us — including marketing emails or texts — about our offerings. You can unsubscribe from marketing messages at any time.

You are responsible for all activity under your account and for keeping your password secure. If you suspect your account has been accessed without your permission, please let us know right away. We reserve the right to suspend or cancel accounts we believe may be compromised.

3. Age & Female Only Services

While there are no age limits for browsing, we recommend that customers are at least 16 years old when booking treatments or purchasing products.

Santal Wellness services are available exclusively to female clients.

4. Content & Third-Party Sites

We do our best to provide helpful, accurate information. However, we don’t guarantee the accuracy or safety of any content, including links to third-party websites. We can’t control or take responsibility for content on external sites or for any damage resulting from visiting them. It’s up to you to take appropriate precautions to prevent harmful and destructive content online including protection from viruses, worms and Trojan horses.

5. Payments, Subscriptions & Refunds

a. Paid Services

Some of our services are only available for a fee (“Paid Services”). By using a Paid Service, you agree to pay the listed price, which includes GST unless otherwise stated.

b. Payment Information

You must provide valid, up-to-date payment details. By entering your payment info, you authorise us to store it securely and charge you for applicable fees. If a payment fails or is flagged as suspicious, we may attempt to charge any updated details provided by your bank or suspend access to your services.

c. Auto-Renewal

If you purchase a subscription, it will renew automatically at the end of each term. We’ll charge the same payment method unless you cancel in advance. Subscriptions must be cancelled at least:

• One month before the end of an annual term

• 24 hours before the end of any shorter subscription term

You can manage or cancel your subscription through your account settings or by contacting us.

d. Fee Changes

We may update our prices occasionally. If you don’t agree with a pricing change, you must cancel before your next billing date or appointment date. Continuing to use a Paid Service after a fee change means you accept the new rate.

e. Refunds

Refunds are only issued in cases where required by law or if we’ve specifically stated otherwise. All other purchases are final. We operate a “no-show policy” — if you miss or arrive late to a booked session, we may still charge for the service. 

6. Feedback & Ideas

We welcome your suggestions and feedback. By sharing ideas with us, you agree we can use them freely, without obligation to credit or compensate you.

7. Your Responsibilities

You represent and warrant that your use of our Services:

• Will be in strict accordance with our terms and the Agreement;

• Will comply with all applicable rules, laws and regulations;

• Will not be for any illegal purposes, or in furtherance of illegal activities;

• Will not infringe or misappropriate the intellectual property rights of Santal Wellness or any third party;

• Will not disclose the personal information of others;

• Will not be used to send spam or bulk unsolicited messages;

• Will not interfere with, disrupt, or attack any service or network;

• Will not be used to create, distribute, or enable material that is, facilitates, or operates in conjunction with, malware, spyware, adware, or other malicious programs or code; and

• Will not involve selling or reselling the Services without Santal Wellness consent. 

8. Updates to These Terms

We may update these Terms as our services evolve or in response to legal changes. Updates will be posted on our website with a revised “Last Updated” date. By continuing to use our services after changes are posted, you agree to the new Terms. If you don’t agree, you should stop using our services.

You have the right to object to any changes at any time by discontinuing your use of our services and cancelling any subscriptions you may have.

9. Cancellation & Termination

We reserve the right to suspend or cancel your access to our services at any time, particularly if we believe you’ve breached these Terms.
You’re free to stop using our services at any time, but any outstanding payments still apply.

10. Disclaimer

All services and content are provided "as is". Santal Wellness makes no guarantees, expressed or implied, about service performance or availability. Use our services at your own risk.

11. Governing Law

These Terms are governed by the laws of New Zealand. If you’re a consumer based elsewhere, you still have rights under your local laws.

12. Limitation of Liability

In no event will Santal Wellness, or its suppliers, partners, or licensors, be liable (including for any third-party products or services purchased or used through our Services) with respect to any subject matter of the Agreement under any contract, negligence, strict liability or other legal or equitable theory. Santal Wellness shall have no liability for any failure or delay due to matters beyond its reasonable control. The foregoing shall not apply to the extent prohibited by applicable law. 

13. Indemnity

You agree to indemnify and hold harmless Santal Wellness, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all losses, liabilities, demands, damages, costs, claims, and expenses, including legal fees, arising out of or related to your use of our Services, including but not limited to your violation of the Agreement or any agreement with a provider of third-party services used in connection with the Services. 

14. Translations

If these Terms are translated into another language, the English version will take precedence in case of conflict.

15. Agreement

The Agreement (together with any other terms we provide that apply to any specific Service) constitutes the entire agreement between Santal Wellness and you concerning our Services. If any part of the Agreement is unlawful, void, or unenforceable, that part is severable from the Agreement, and does not affect the validity or enforceability of the rest of the Agreement. A waiver by either party of any term or condition of the Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof.

Santal Wellness may assign its rights under the Agreement without condition. You may only assign your rights under the Agreement with Santal Wellness prior written consent.
